Terms of Service

Early access

Plenia is in early access. We are actively building it, so features may change, be added or be removed, and the Services may sometimes be unavailable. We may limit who can join early access and may end it with reasonable notice.

Accounts

• Keep your sign-in details secure, and tell us right away at contact@getplenia.com if you think someone has used your account without permission.
• The owners of a Plenia company decide who can use it, what each person can see and do, and which devices are set up as shared tablets. You are responsible for the people you add and for activity under your company.
• You must give accurate information when you create an account, and you must be at least 18 years old.

Your data

• It belongs to you. The information you and your team put into Plenia, or bring in from connected services, is your data (“Customer Data”). You give us permission to host, copy, process and display it only as needed to provide, protect and improve the Services for you and as described in our Privacy Policy.
• Personal information about others. Your data may include personal information about your team members, property owners, clients or others. You are responsible for having the right to provide it, and for giving any notices and getting any permissions the law requires.
• Downloading and deleting. Company owners can download a copy of their company's data and delete the company at any time from Settings. A deleted company can be restored for 7 days; after that it is permanently deleted. Copies in our backups are removed within 7 days after that.

Connected services

You can connect Plenia to other services you use, such as a property management system. When you do, you authorize us to access those services with the credentials or permissions you provide, and to bring information into Plenia and keep it up to date. Those services are provided by other companies under their own terms, and we are not responsible for them. If a connected service changes or stops working, related features in Plenia may change or stop. You can disconnect a service at any time.

Acceptable use

You agree not to:

• use the Services for anything unlawful, harmful or fraudulent;
• try to access another organization's data, or get around security, permissions or usage limits;
• upload malicious code, or put an unreasonable load on the Services;
• copy, resell or reverse engineer the Services, or use them to build a competing product; or
• upload content that you don't have the right to share.

Fees

The Services are free during early access. Before we start charging for Plenia, we will tell company owners about the price and plans at least 30 days in advance, and you can choose whether to continue. Paid plans will be described when you sign up for them, and any taxes are your responsibility.

Feedback

We welcome suggestions and bug reports, including those sent with the Feedback button. You agree that we may use your feedback to improve Plenia without any obligation to you.

Our property

Plenia, including its software, design and brand, belongs to us. These Terms give you the right to use the Services while you follow them; they don't transfer any ownership.

Ending these Terms

You can stop using Plenia at any time. We may suspend or end your access if you seriously or repeatedly break these Terms, if your use puts the Services or other customers at risk, or if the law requires it. When we can, we will give notice first and a chance to download your data. The sections on your data, our property, disclaimers, limits on liability, indemnity and governing law continue to apply after these Terms end.

Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Services will be uninterrupted or error-free. Plenia helps you track supplies and charges, but you are responsible for checking counts, prices and anything you bill to others.

Limits on liability

To the fullest extent the law allows, neither you nor we will be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, even if told they were possible. Our total liability for any claim related to the Services is limited to the greater of the amount you paid us for the Services in the 12 months before the claim, or $100.

Indemnity

You will defend and hold us harmless against claims by third parties arising from your data, or from your use of the Services in breach of these Terms or the law.

Changes to these Terms

We may update these Terms. If a change is significant, we will tell company owners at least 30 days before it takes effect, by email or in the app. If you keep using the Services after a change takes effect, the updated Terms apply.

Governing law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Any dispute will be heard in the state or federal courts located in Wyoming, and both parties agree to their jurisdiction.

General

These Terms and the Privacy Policy are the entire agreement between you and us about the Services. If any part is found unenforceable, the rest still applies. If we don't enforce a part right away, we don't give up the right to enforce it later. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets. We may send notices to the email address on your account.
